ARTICLE - GENERAL PROVISIONS RELATING TO THESE GENERAL TERMS AND CONDITIONS OF SALE (HEREAFTER THE GTC)

Purpose of the GTC
The GTC apply exclusively to online sales of The French Lab products on the website Mimetique.com (hereinafter referred to as "the site"), which is open to access.

Scope of Application of the GTC
The GTC exclusively govern contracts for the online sale of The French Lab products (hereinafter referred to as "the professional seller") to buyers who qualify as consumers (hereinafter referred to as "consumers") and constitute, along with the online order, the contractual documents binding on the parties, to the exclusion of all other documents, brochures, catalogs, or photographs of the products which only have indicative value.
The GTC exclusively apply to products delivered to consumers established in France and/or in a member country of the European Union.
The GTC are drafted, as well as all contractual information mentioned on the site, in French.

Availability and Opposability of the GTC
The GTC are directly made available to consumers on the seller's website. The GTC are binding on the consumer who acknowledges, by checking a box provided for this purpose, that they have read and accepted them before placing an order. The validation of the order by confirmation constitutes acceptance by the buyer of the GTC in effect on the day of the order, the conservation and reproduction of which are ensured by the professional seller in accordance with Article 1127-2 of the Civil Code (formerly C. civ., art. 1369-4).

Modification of the GTC
These GTC were updated on June 30, 2023.
The professional seller reserves the right to modify its GTC at any time.
In the event of modification of the GTC, the applicable GTC are those in effect on the date of the order, of which a dated copy may be provided upon request to the consumer.

Clauses of the GTC
The nullity of a contractual clause does not entail the nullity of the GTC. The temporary or permanent non-application of one or more clauses of the GTC by the professional seller shall not constitute a waiver of their part to the other clauses of the GTC, which continue to produce their effects.
This contract and the GTC governing it are subject to French law.

ARTICLE - RETURN OF PRODUCTS AND RIGHT OF REFUND
The consumer has a right to return within fourteen days from the receipt of their order to return any item that does not suit them and request an exchange or refund, except for the return shipping costs, which remain at their expense.
The right of withdrawal can be exercised by contacting our customer service directly from our website in the "Contact Us" section. We will promptly send you an acknowledgment of receipt of the withdrawal on a durable medium (e.g., by email).
Returns must be made in their original condition and complete to allow for their resale in new condition. Any product opened or damaged by the consumer will not be accepted for return.
In the case of withdrawal, The French Lab will refund the total payments received, either by recrediting the consumer's credit card or PayPal account, or by bank transfer depending on the payment method used for the order. The French Lab may defer the refund until the products have been received and verified.

ARTICLE - TERMS OF SERVICE

THE PRODUCTS:

Characteristics
The products offered for sale presented in the catalog published on the site each have a description mentioning their essential characteristics within the meaning of Article L. 111-1 of the Consumer Code. The photographs illustrating the products do not constitute a contractual document.

Use of Products
The site offers for sale products allowing for care treatments. These products are intended for individuals only. Some products offered on the site may be highly concentrated, very powerful, and may be dangerous in case of incorrect use. The French Lab provides consumers with the necessary information for the proper use of the products.
The French Lab cannot be held responsible for damages caused by improper use of the products sold on its site or by non-compliance with the instructions for use.

Compliance
The products comply with current regulations regarding the safety and health of individuals, fair trading practices, and consumer protection at the time of their marketing. The products comply with the provisions of French law in effect at the time of their marketing.

Stock Availability
The products are offered and delivered within the limits of available stock. In the event of unavailability of the ordered product, the seller will inform the buyer immediately and may offer a product of equivalent quality and price or, failing that, a gift voucher for the amount of the order usable for any future order.
In the event of disagreement from the buyer, the seller will refund the amounts paid within 5 working days. Beyond the refund of the price of the unavailable product, the seller is not liable for any cancellation compensation unless the non-performance of the contract is personally attributable to them.

Resale of Products
Products sold on the site cannot be resold without the written consent of The French Lab. Products sold on the site cannot be repackaged and resold without the written consent of The French Lab.

THE PRICES:

The selling prices in accordance with Article L. 112-1 of the Consumer Code are indicated for each product in the electronic catalog in euros, all taxes included, excluding delivery and transportation costs mentioned before validation of the order and charged in addition.
The total amount due from the consumer is indicated on the order confirmation page.
The selling price of the product is that in effect on the day of the order.
The selling price of the products does not include shipping costs charged in addition to the price. These costs are indicated to the consumer before the validation of the order.

In the event of an order to a country other than France, the consumer is considered the importer of the product, and it is their responsibility to ensure compliance with the regulations in force in the country of delivery.

Prices may be modified by the seller at any time. Products are billed based on the rates in effect at the time the order is recorded, subject to availability on that date.

THE ORDER:

Placing the Order
The consumer places their order online, from the catalog and using the registration form. To validate the order, the buyer must accept, by clicking at the designated location, these GTC. Any order involves a minimum amount of €10.

Order Confirmation
The sale will only be considered final after the consumer receives the order confirmation from the seller and the seller has received the full payment.

Order Modification
The consumer has the possibility to modify their order until the moment the seller has confirmed it. From that moment on, the consumer can no longer modify their order. The order is definitive after the confirmation has been sent by the seller.

Order Summary
The buyer has the possibility to verify the summary of their order, which includes the following elements: identification of products, unit selling price, quantities, total price, as well as delivery options. In the event of an error in the information provided by the consumer during the order, the seller cannot be held responsible for the inability to deliver the product.

PAYMENT:

Payment Methods
Payment for purchases is made only by credit card (Visa, Mastercard) or PayPal. Payment is secured by an online payment system, so that information is encrypted and inaccessible to third parties. Payments can be made in one payment or in several payments (3 times without fees), depending on the order. The order will be processed upon receipt of payment.

Payment Security
Payment information is secured by the 3D Secure system to guarantee the security of transactions.

Late Payment
In the event of total or partial non-payment at the agreed deadline, late payment penalties may be applied to the buyer. These are calculated based on an interest rate equal to three times the legal interest rate in effect. The amount due will also be increased by €40 for recovery costs.
