ARTICLE - TERMS OF SERVICE

THE PRODUCTS:

  1. Characteristics
    The products offered for sale, presented in the catalog published on the site, each have a description mentioning their essential characteristics according to Article L. 111-1 of the Consumer Code. The photographs illustrating the products do not constitute a contractual document.

  2. Use of Products
    The site offers products for sale that allow for care treatments. These products are intended for individuals only. Some products offered on the site may be highly concentrated, very powerful, and could be dangerous if misused. The French Lab provides consumers with the necessary information for proper use of the products. The French Lab cannot be held responsible for damages caused by improper use of the products sold on its site or by failure to comply with usage precautions.

  3. Compliance
    The products comply with current regulations regarding the safety and health of individuals, fair trading practices, and consumer protection at the time of their marketing. The products comply with the provisions of French law in effect at the time of their marketing.

  4. Stock Availability
    The products are offered and delivered within the limits of available stock. In case of unavailability of the ordered product, the seller will immediately inform the buyer and may offer a product of equivalent quality and price or, failing that, a gift voucher for the amount of the order usable for any future order.
    If the buyer disagrees, the seller will refund the amounts paid within 5 working days. Beyond the refund of the price of the unavailable product, the seller is not liable for any cancellation compensation unless the non-performance of the contract is personally attributable to them.

  5. Resale of Products
    Products sold on the site cannot be resold without the written consent of The French Lab. Products sold on the site cannot be repackaged and resold without the written consent of The French Lab.

THE PRICES:

  1. The selling prices in accordance with Article L. 112-1 of the Consumer Code are indicated for each product in the electronic catalog in euros, all taxes included, excluding delivery and transportation costs mentioned before validation of the order and charged in addition. The total amount due from the consumer is indicated on the order confirmation page. The selling price of the product is that in effect on the day of the order. The selling price of the products does not include shipping costs charged in addition to the price. In case of promotional pricing, the professional seller commits to applying the promotional price to any order placed during the promotional period.

  2. Modification: The professional seller reserves the right to modify its prices at any time while guaranteeing the consumer the application of the price in effect on the day of the order.

  3. Fees: Additional transport, delivery, or postage fees (to which other potential costs incurred by the seller must be added), which the client has been made aware of before the order, are specified on the order form.

OFFER:

  1. Scope: The online sale offers presented on the site are reserved for consumers residing in France and/or in a member country of the European Union, for deliveries within these same areas.

  2. Duration: The online sale offers presented on the site are valid, unless otherwise indicated, as long as the products appear in the electronic catalog and within the limits of available stock.

  3. Acceptance: The acceptance of the offer by the consumer is validated, in accordance with the double-click process, by the confirmation of the order.

THE ORDERS:

  1. Steps to Conclusion of the Contract: To place an order, the consumer, after filling their virtual cart by indicating the selected products and desired quantities, clicks on the "Order" button and provides delivery and payment information. Before clicking on the "Confirm the order" button, the consumer has the opportunity to verify the details of their order and total price and return to previous pages to correct any errors or potentially modify their order. The confirmation of the order leads to acceptance of the GTC and forms the contract. An email acknowledging receipt of the order and its payment is sent by the seller as soon as possible.

  2. Order Modification: Any modification of the order by the consumer after confirmation is subject to the acceptance of the professional seller. The professional seller reserves the right to make modifications to the ordered product related to technical developments under the conditions provided in Article R. 212-4 of the Consumer Code.

  3. Order Validation: The professional seller reserves the right to refuse any order for legitimate reasons, particularly if the quantities of products ordered are abnormally high for buyers who qualify as consumers. The seller may also refuse or delay processing an order if it suspects any fraud, such as identity theft or payment method theft.

THE CONTRACT:

  1. Conclusion: The sales contract is formed at the time the consumer sends confirmation of their order.

  2. Archiving and Proof: Archiving communications, order forms, and invoices is done on a reliable and durable medium to constitute a faithful and lasting copy in accordance with Article 1360 of the Civil Code (formerly C. civ., art. 1348). These communications, order forms, and invoices may be produced as proof of the contract.

 

THE PAYMENT:

  1. Demand: The price is due in full upon confirmation of the order. Payment is made immediately upon ordering by credit card.

  2. Payment Security: The site is equipped with a secure online payment system allowing the consumer to encrypt the transmission of their banking data via the secure payment platform’s server. At no time will the consumer's banking data pass through The French Lab's computer system.

DISPUTE RESOLUTION:
The French Lab cannot be held responsible for damages resulting from improper use of its products. In case of a dispute, you should first contact the company's customer service via email (hello@mimetique.com) to attempt to resolve the dispute informally.
